Jessica Furst Johnson Speaks to POLITICO Pro on the NRSC Suit Against a Super PAC

Earlier this week, the National Republican Senatorial Committee ("NRSC") filed a lawsuit in a federal District Court in California against Red Senate, a super PAC that the committee asserts is misleading donors. The group has used Senator Rick Scott’s likeness, primarily in digital ads, in fundraising appeals and has also claimed to support other Republicans running in competitive Senate races, yet funds raised are primarily paying Red Senate consultants and going toward operating expenses.

Jessica Furst Johnson, counsel to the NRSC, spoke with POLITICO Pro about the premise of the lawsuit.  She discussed the concept of scam PACs, and the importance of further regulation to ensure that donors are protected and understand exactly what their contributions are funding. She commented on the difficulty of identifying and deterring scam PAC activity given the prohibition on coordination between super PACs and federal candidates and the intense proliferation of online fundraising over the past decade.
